Terms and Definitions

1.1. For the purposes of this User Agreement, the following terms have the following meanings: Site - an Internet resource (hereinafter referred to as the Platform), located on the Internet at https://splay.uz. The Platform, depending on the context, also means Platform software, design (graphic design) of the Platform, Database, any section (subsection) of the Platform (“Poster & TV”, “Texts”, “Communication”, etc.), as well as Information posted on the Platform. Administration of the Platform - Master Media Production and Broadcast LLC, which owns all relevant exclusive property rights to the Platform, including rights to the domain name of the Site, and administers it. The subject of this User Agreement is the relationship between Master Media Production and Broadcast LLC. a legal entity registered and operating under the legislation of the Republic of Uzbekistan, which is the administrator of the site https://splay.uz and the “Splay” platform, and the “User” regarding the use of online content, including Content, access to viewing of which is provided through the platform on various User devices.
User is a person who has completed the registration and (or) authorization procedure under the terms of Section 3 of this Agreement, and also has his own Profile. For the purposes of the User Agreement, the User also means a person who has not completed the registration procedure, but accesses the Platform and/or uses and/or has used it. Any person accessing the Platform automatically confirms that he fully agrees with the provisions of this User Agreement and that the requirements established by this User Agreement are applicable to him. User Profile / Profile is a special subsection of the Platform where Personal information about the User is located, as well as other information that can only be posted by the User himself.
Personal information of the User - information about the User of the Platform received in connection with the User’s use of the Platform, classified as the User’s personal information in accordance with the Privacy Policy. Information - information posted (posted) by the User or the Platform Administration on the Platform, including: Personal information of the User, links to other sites, any text messages, movie reviews (User Reviews), photographs (images), audio and/or video works, computer programs, and other files. Database is a collection of Information posted (posted) on the Platform. All Information posted on the Platform, as well as the selection, grouping and arrangement of Information, is the intellectual property of the Platform Administration and (or) other copyright holders.
Spam - mass, unauthorized and/or unexpected by recipients mailings and other mailings of an advertising, informational, propaganda or other nature.

Subject and General Provisions of the User Agreement

2.1. This User Agreement establishes the rules and conditions for using the Platform, posting Information on it, and represents an agreement between the User and the Platform Administration, replacing all previous agreements between the User and the Platform Administration.

2.2. Accessing the Platform, using its features, and/or performing any other actions on the Platform by the User implies that the User accepts and agrees to comply with all the terms of this Agreement.

Registration and Authorization on the Platform

3.1. In order to access all the features of the Platform, the User must undergo the registration procedure as a new User, providing all necessary information during the registration stages. The User may also be offered authorization using the account of third-party services that support integration with the Platform. By using the account of third-party services, the User agrees to the processing of the information provided in their account under the conditions of the Privacy Policy for the purpose of utilizing the Platform's features.

3.2. The User agrees to provide truthful, accurate, and complete information about themselves during registration and to keep this information up to date. In the event of any changes to such information, the User undertakes to update their data in accordance with these changes at the time of their first login to their profile. The User agrees that the Platform Administration is generally not obliged to verify the accuracy of the User's Personal Information and does not monitor the User's legal capacity.

3.3. The Platform Administration has the right to block and/or delete the User's Profile, deny access to some or all features of the Platform, and delete User Information without explanation of reasons, including in case of the User's violation of the terms of the Agreement. This includes situations where the User provides inaccurate information about themselves, or if the Platform Administration has reason to believe that the information provided by the User is unreliable, incomplete, inaccurate, violates the terms of this Agreement, or the User is using someone else's information.

3.4. The individual login and/or password of the User, necessary for authorization on the Platform, are intended solely for that User. The User must keep their access data to the Platform personally, not transfer them to third parties, or log in on unknown devices under their account.

User's Personal Information

4.1. Personal information of the User is processed in accordance with the terms of the Privacy Policy.

4.2. The User agrees that their Personal Information contained in the User's Profile is publicly accessible, and any Site User may access it, except for Personal Information that the User may restrict access to using the corresponding Site functionality.

4.3. The User confirms that they voluntarily place their personal Personal Information on the Service.

4.4. The User undertakes not to specify or post on the Service the Personal Information of third parties and not to use the Personal Information of other users.

Posting Information on the Service Platform

5.1. The User agrees, when using the Platform and its Services, not to post and not to use the Platform to obtain, distribute the following information:
violating the rights and legally protected interests of third parties;
not to disrupt the normal operation of the Platform;
not to distribute and/or use any computer programs, robots ('spiders,' 'grabbers'), or other automatic algorithms and methods aimed at 'crawling' (collecting), illegal transmission, copying, blocking, modification, destruction of Information and Databases, as well as circumventing restrictions set by the Platform Administration in the Service settings;
not to post or otherwise use on the Site Information protected by intellectual property laws (including, but not limited to, Information affecting patents, trademarks, copyright and/or related rights), and other legally protected Information.

5.1.1. Splay is not responsible for the content or other information posted on the Service, as well as the accuracy of the classification of information products. The responsibility for the content of the content and the proper classification of information products lies entirely with its right holders who provided such information.

5.2. The Platform Administration may, at its discretion, refuse to post, delete, and/or edit the Information posted on the Platform by the User if it is unrelated to the topic of discussion and/or has a negative nature.

5.2.2. Splay reserves the right at its discretion to limit the User's access to the Service (or to certain Service features, if technologically feasible) using their account or to completely block the User's account for repeated violations of these Terms or to take other measures to comply with the requirements of the law or the rights and legitimate interests of third parties.

5.3.1. The service administration is not responsible for the uninterrupted provision of the Service's functionality as a whole or specific units of Content. Some units of Content may be unavailable in certain territories of Service provision (in individual settlements, regions, countries) for technical reasons, due to restrictions imposed by rights holders regarding specific Content, or for other reasons.

5.4. All questions, inquiries, and claims related to the use/inability to use the Service, as well as possible violations of the law and/or the rights of third parties, should be addressed to: splayuz@gmail.com

Use of the Platform

6.1. The User is allowed to use the Platform only in accordance with this Agreement and exclusively by means provided by the technical capabilities of the Platform.

6.2. Rights holders regarding the Information posted on the Platform are, in the relevant cases, the Platform Administration and/or third parties.

6.3. The User has no right to in any way modify, copy, delete, save, download, distribute, transmit, sell, 'post,' and otherwise use the Information posted on the Platform Services.

6.4. Users undertake to use the Information, as well as any other information contained on the Site, only for personal non-commercial purposes.

Functioning of the Platform and Responsibility in its Use

7.1. The Platform Administration strives to ensure the proper functioning of the Platform Services 24/7; however, the Administration is not responsible if any disruptions occur in the operation of the Platform for any reason.

7.2. The Platform Administration does not guarantee that the Information posted on the Platform will be available at all times, or that it will not be deleted or lost. The Platform Administration is not responsible for malfunctions and delays in the operation of the Services, as well as for the possible consequences of such malfunctions and delays.

Use of the Service. Specific Functions of the Service

8.1. The Service is intended for displaying units of Content to the authorized User at their choice in streaming mode on the User's devices and/or by downloading units of Content for display through websites, mobile applications, Smart TV applications.

8.2. The full functionality of the Service is available to the User upon authorization in the Service. User authorization is carried out on the terms

8.3. The User is not provided with the ability to further copy such a unit of Content;

Intellectual Property

9.1. Upon starting to use the Service, the User guarantees that they do not and will not take any actions aimed at bypassing technical means of protection against unauthorized use of Content, in particular, taking measures to bypass the system of territorial restrictions on displaying Content by IP addresses, as well as any other actions directed against the normal operation of the Service and its Users.

9.2. The display of Service Content is intended exclusively for personal non-commercial purposes within the technical capabilities provided by the Service. Any copying, reproduction, processing, distribution, bringing to the public, bypassing technical protection means, or other use of Content beyond the capabilities provided by the Service, as well as any commercial use, is prohibited.
